Buying a property in Turkey is a lifelong dream for many expats. However, it's not enough to simply find a beautiful apartment by the sea and agree on a price with the seller. Buyers must carefully examine the land registry entry, the building regulations, the payment process, any encumbrances, and their personal tax situation.

However, the subsequent sale is just as important. Mistakes made during the purchase often only reveal their financial consequences years later. Therefore, this guide examines the entire process: from the initial property offer through the transfer of ownership to a later sale.

📌
The most important points in brief: In Turkey, ownership of real estate is generally only established upon registration with the state land registry. A purchase agreement, a reservation, or a payment alone does not make the buyer the owner. Furthermore, a Tapu (registration of title) does not automatically mean that the building complies with all building regulations or that the buyer will receive a residence permit.
From our own testing experience: This article doesn't just discuss theoretical regulations. Rather, through our own experience in examining and marketing various properties, we've witnessed firsthand how significantly tapu status, official valuation, actual market price, translations, powers of attorney, and tax deadlines can impact a transaction.

1. How does one become a legal owner in Turkey?

The legally binding transfer of ownership takes place at the responsible land registry office, the Tapu Müdürlüğü. Therefore, a full payment of the purchase price should generally not be made without security long before the land registry date.

A private purchase agreement can certainly regulate important obligations. However, it does not replace registration in the land register. Even a notarized promise to sell is not equivalent to the final transfer of ownership.

The secure payment system from December 1, 2026

The Turkish Ministry of Commerce has introduced a secure payment system, the so-called Güvenli Ödeme Sistemi, for real estate sales. Originally, its mandatory use was scheduled to begin on July 1, 2026. However, the launch was first postponed to October 1, 2026, and then, by decree No. 33387 in the Resmî Gazete of October 1, 2026, to December 1, 2026. Until then, the existing procedures remain in effect.

The system is designed to ensure that ownership and purchase price change hands as simultaneously as possible. To achieve this, the money is deposited into the system via an authorized payment service provider or bank. Only after the transfer of ownership has been confirmed will the funds be released to the seller. This is intended to reduce the following risks in particular:

  • Payment without subsequent transfer of ownership
  • Handover of large sums of cash
  • false or manipulated payment receipts
  • Fraud by unauthorized persons
  • undocumented purchase price components

Source: Ticaret Bakanlığı — Basin Açıklaması · Duyuru: Erteleme on October 1, 2026

Until the mandatory launch, buyers and sellers must still agree on a secure, individual payment processing method. Therefore, the purchase contract should clearly specify the amount to be paid, when, to which account, and under what conditions.

📄 1. Purchase agreement Set conditions 💳 2. Payment secured Bank / Güvenli Edema 🏨 3. Tapu appointment At the land registry office ✅ 4. Transfer of ownership Release to seller Compulsory from December 1, 2026: the Güvenli Ödeme Sistemi links payment and ownership transfer more closely.
CASE STUDY

Payment and Tapu must match

In practice, we repeatedly encounter situations where buyers are asked to transfer large sums of money even before the title deed (Tapu) is signed. At the same time, however, important documents are still missing, or the encumbrances on the property have not been fully investigated.

Therefore, we recommend always linking payment stages to specific conditions. For example, the final payment could be made dependent on mortgages being cleared, missing documents being submitted, and the transfer of ownership actually being completed.

2. What does Döviz Alım Belgesi mean?

When foreign individuals purchase real estate, a Döviz Alım Belgesi, or DAB for short, is regularly required. This involves converting the foreign currency intended for the purchase into Turkish Lira through a Turkish bank.

The bank generally transmits the necessary information electronically to the land registry. Therefore, the buyer should coordinate the process with their bank, the land registry, and any advisors involved before making the transfer.

Also important is: The purchase price, bank statements, DAB (German Federal Register of Deeds), and the value declared at the land registry must all match. Discrepancies can lead to inquiries or tax problems later on.

3. Which documents need to be checked before the purchase?

A tapu is necessary, but it doesn't answer all questions. Therefore, the exam should cover at least four areas:

Land register and owner

First, it must be clarified who the actual owner is. Furthermore, existing mortgages, liens, rights of use, rights of first refusal, court notices, and other encumbrances must be examined.

Especially when there are multiple owners, the consent of a single person is not sufficient. Rather, it must be clarified who is authorized to sell and whether valid powers of attorney exist.

Building law and approved use

Next, it must be verified whether the actual property matches the officially approved plans. This includes, among other things:

1

Balconies enclosed after the fact

2

Increased living space

3

Unauthorized attics

4

Combined apartments

5

Additional rooms

6

Alternative uses

7

Unapproved outbuildings

A deviation from the standard regulations does not automatically mean that the property is unsellable. However, it can later cause problems with financing, insurance, renovations, residency permits, or resale.

Kat İrtifakı, Kat Mülkiyeti and İskan

Buyers of apartments often encounter the terms Kat İrtifakı and Kat Mülkiyeti.

Kat İrtifakı

Basically refers to a model for the expectancy of ownership of a condominium or a construction phase model.

Kat Mülkiyeti

In contrast, it stands for registered condominium ownership in a completed building.

However, one should not draw hasty conclusions from the Tapu status alone. It is also crucial whether a Yapı Kullanma İzin Belgesi, colloquially known as İskan, has been granted. If a usage permit exists, the conversion of Kat İrtifakı to Kat Mülkiyeti can be carried out ex officio under certain conditions.

A missing İskan It doesn't automatically block every sale. Nevertheless, the reason for its absence should be clarified. The missing document could be due to deviations from building regulations, outstanding obligations of the developer, or problems with the building as a whole.

Source: TC e-Devlet Kapısı — Yapı Kullanma İzin Belgesi (İskan)

DASK and insurance

For buildings, mandatory earthquake insurance (DASK) is regularly required. It is requested for certain land registry and utility connection processes, among other things. However, DASK does not replace comprehensive building or contents insurance.

Check additionally: What year was the building constructed, according to which earthquake standard was it built, and were any changes made to the load-bearing structure?

Source: DASK — Doğal Afet Sigortaları Kurumu (official site)

4. Our experience: A low price is not automatically a good deal.

In our experience, we have repeatedly found that the crucial questions only arise after the initial site visit.

What the tour shows

An apartment may appear to be renovated, even though the legal or technical condition of the building remains unclear. Similarly, a villa may seem to offer a large living area at first glance, while part of the area is not listed in the approved documents.

What else we check

Therefore, we don't just consider furniture, views, and amenities. Rather, we work with the relevant experts to examine the legal and structural aspects.

  • What does the Tapu actually say?
  • What uses are permitted?
  • Is there an İskan?
  • Do the plan and the actual situation match?
  • Are there any outstanding issues or pending legal proceedings?
  • Is the asking price justifiable based on market conditions?
  • What problems could arise during a later sale?

This combination of document review and practical considerations therefore creates greater security.

5. Are foreigners allowed to buy real estate and land in Turkey?

Foreign nationals are generally permitted to purchase real estate in Turkey, provided their citizenship is valid and no legal restrictions apply. The following limitations, among others, apply:

upper limit of the area

In general, foreign individuals are not permitted to acquire more than 30 hectares in total.

Share per county

In a district, the foreign ownership share may be legally limited.

Restricted areas

Purchase may be prohibited in military restricted or security zones.

Further restrictions

Additional restrictions may apply for certain nationalities or types of property.

Source: Tapu Kanunu No. 2644, Art. 35 (mevzuat.gov.tr)

Special features of undeveloped land

If a foreign person buys an undeveloped plot of land, they must generally develop a project within two years and submit it to the relevant ministry for approval.

If this obligation is not fulfilled, official liquidation or realization proceedings can be initiated. Therefore, the statement that a foreign buyer can simply keep a plot of land undeveloped indefinitely is too general. Furthermore, not every property offered as "land" is actually building land. A Tapu (land register) designated as Tarla, meaning agricultural land, says nothing about whether and to what extent construction is permitted.

Therefore, check: Land use plan, development plan, road connection, parceling, protection status and possible public areas — all before a „property“ is booked as a capital investment.

6. Is a government-issued property valuation required?

For transactions involving foreign parties, an official valuation or a legally prescribed valuation procedure is required.

Since December 2024, the Tutar Tespit Belgesi (TTB) has been used, among other methods, for such transactions. However, the exact form depends on the type of transaction. Therefore, it is advisable to check which documents the responsible Tapu Müdürlüğü (Tax Authority) requires before submitting an application.

Important: A value determined by an official or judicial authority is not automatically the price that can actually be achieved on the free market.

Source: TKGM — Yabancılar Daire Başkanlığı, Frequently Asked Questions (TTB)

CASE STUDY

The official value and the market value are not identical.

In our practice, we handled a case where a valuation had already been established through legal or enforcement proceedings. Nevertheless, it was necessary to assess whether this valuation was also realistic for normal marketing on the open market.

Because a valuation report can yield different results depending on the reason for the report, the valuation date, the condition of the property, and the valuation method used, we often recommend an additional independent, licensed market valuation for exceptional or high-priced properties.

7. Does buying real estate automatically lead to a residence permit?

No. Property ownership and residency rights are two different legal areas. Anyone wishing to apply for a short-term residence permit based on property ownership must own a property suitable as a residence and generally use it themselves for residential purposes.

Current minimum value: Currently, a minimum value of approximately US$200,000 is required for such applications. However, the decisive factors are the applicable official regulations and the values recognized for the specific property. Furthermore, the address must not be subject to any current residency restrictions.

Are Mahmutlar, Kestel and other districts open again?

Special caution is required here. Some sources online claim that numerous previously closed-off districts will have been fully reopened in 2026.

⚠️ Beware of sweeping statements: There is no general official announcement stating that all known restricted areas have been permanently reopened. The official notification regarding the 1,169 closed neighborhoods dates back to 2022. Therefore, the specific address should be checked immediately before purchasing property and applying for residency (Ikamet). Successful processing of an individual application in the e-Ikamet system does not necessarily mean that a neighborhood is generally open to all types of applications and all individuals.

More details (see separate article): Ikamet restrictions lifted in Alanya: What buyers & renters should know for 2026

CASE STUDY

Check the address first, then buy.

In our experience, it is risky to buy a property solely based on the statement "Ikamet possible". Therefore, the buyer should clarify the following before reserving:

  1. On what legal basis should the application be submitted?
  2. Does the property reach the required value?
  3. Is the specific address permissible for the desired type of application?
  4. What documents does the local Göç İdaresi require?
  5. Are there any special considerations due to nationality or family?

A real estate agent cannot provide a legally binding guarantee of residency. However, a thorough preliminary check can significantly reduce the risk of a bad purchase.

8. What are the additional purchase costs?

In a standard real estate sale, the land registry fee is generally four percent of the declared transfer value. By law, both buyer and seller are charged two percent. In practice, however, it is often agreed that the buyer will bear all the fees. Therefore, the cost allocation should be explicitly stated in the contract.

Legally Buyer 2% Seller 2% In practice Buyers often wear all 4% The actual cost allocation should always be explicitly stated in the purchase contract.

Additionally, the following may occur, among other things:

1

Land registry fees

2

Valuation or expert fees

3

Translation costs

4

Notary fees

5

Legal fees

6

Broker's commission

7

DASK and other insurance companies

8

Bank and transfer fees

9

Value added tax may apply to new buildings.

⚠️ Intentionally stating a purchase price too low in the Tapu is strongly discouraged. If it is later determined that the declared value does not correspond to the actual purchase price, fees may be levied retroactively and tax penalties may be imposed.

9. What do owners need to consider when selling later?

Many buyers only start thinking about taxes once they already have a potential buyer. However, the sales strategy should be considered right from the acquisition stage.

The five-year period

If a private individual sells a property acquired for consideration within five years, the capital gain may be subject to taxation in Turkey as Değer Artışı Kazancı.

For 2026, the tax-free allowance for corresponding capital gains is 150,000 Turkish Lira. However, the taxable gain is not simply calculated as the difference between two euro amounts. Rather, factors such as the documented purchase price, permissible expenses, and legally mandated indexation can be taken into account.

Source: Gelir Idaresi Başkanlığı (GİB) — Istisna-Tutarı Değer Artışı Kazancı

Years 0–5: possibly taxable Değer Artışı Kazancı From year 5 onwards: regularly tax-free Income tax is waived 0 Year 0 — Purchase 5 5 years Tax-free allowance 2026: 150,000 TL Applies to private sales — commercial activity and German tax obligations may differ.

If a property is held for more than five years, the private capital gain is generally exempt from this income tax in Turkey. However, special rules apply if properties are bought and sold repeatedly or as part of a business activity. Therefore, the five-year rule should not be applied to every business model without careful consideration.

The risk of a Tapu level that is too low

A particularly common problem arises when a significantly too low value is declared in the title deed (Tapu) at the time of purchase. Upon subsequent sale, an unusually high profit then appears on paper. Furthermore, reliable evidence of the actual purchase price paid is often lacking.

Therefore, the actual flow of payments should be fully documented. This includes, in particular:

  • Purchase agreement
  • Bank transfers
  • DAB
  • invoices
  • Tapu documents
  • Renovation bills
  • Broker and consulting fees
  • Appraise
CASE STUDY

The tax period must be clarified before marketing begins.

When handling sales mandates, we therefore investigate early on when and how the owner acquired the property. We also inquire about the value recorded in the title deed (Tapu) at the time and whether any documentation exists regarding additional costs.

This makes it possible to determine before marketing whether a five-year period is in effect, whether a tax return might be required, and what minimum selling price is actually reasonable.

10. What applies in the case of a previous VAT exemption?

Certain foreign buyers and Turkish citizens living abroad may be exempt from Turkish VAT when purchasing a newly constructed apartment or commercial unit for the first time, under certain conditions.

However, several conditions must be met. Among other things, it must be a first delivery eligible for preferential treatment, the purchase price must be properly brought into Turkey in foreign currency, and the buyer must not be considered a resident of Turkey.

When reselling, please note: If the property in question is resold within three years, the tax that was not initially levied, including the accrued interest, must generally be paid retroactively before the transfer of ownership. Therefore, it should be checked before every sale whether a corresponding entry has been made in the land register.

11. What applies to German taxpayers?

The double taxation agreement between Germany and Turkey generally assigns the right to tax profits from Turkish real estate to Turkey.

For individuals who remain tax residents in Germany, the income may be relevant for calculating the German tax rate. Furthermore, the profit is determined according to German tax law, which is why the German approach may differ from the Turkish calculation. Therefore, the simplified statement "After five years, the sale is tax-free everywhere" is not reliable.

Before a sale, these questions in particular should be clarified:

  • Where is the seller resident for tax purposes?
  • Do you still have a residence or habitual abode in Germany?
  • When was the property acquired under German tax law?
  • Is this private or business property?
  • What costs and currency conversions need to be factored in?
  • Does the progression clause apply?
💬
In cross-border cases, a tax advisor should therefore be involved who takes both the Turkish and German sides into account.

12. Short-term rentals and the 100-day rule

Rentals for a maximum of 100 days are generally considered tourist rentals and require a corresponding permit.

⚠️ Highest hurdle in practice: For an apartment in a multi-family building, a notarized, unanimous resolution from all apartment owners in the building or block in question is generally required. A mere majority of the owners attending a meeting is insufficient. Therefore, no one should buy an apartment solely on the promise that it can be easily rented out via Airbnb or similar platforms.

Source: Resmi Gazete — Yönetmelik: Konutların Turizm Amaçlı Kiralanması

Before buying, the following must be checked:

Legal framework

Building type, owners' resolutions, administrative regulations and eligibility for approval.

Operation & Reporting

Tax registration, fire safety and equipment requirements, and reporting obligations for guests.

13. What does Kentsel Dönüşüm mean for owners?

For older buildings, the Turkish urban renewal concept, Kentsel Dönüşüm, may become relevant.

If a building is officially classified as high-risk, decisions regarding its further development can generally be made by an absolute majority of ownership shares. Therefore, it is not simply a matter of a majority of the people present, but rather of the corresponding land or co-ownership shares.

Consequences of objection: Owners who do not comply with a duly adopted majority decision may, under the legal conditions, be subject to proceedings to sell their shares. However, formal notification, deadline, and procedural requirements apply. Therefore, for owners residing abroad, a current service address and, if necessary, reliable legal representation in Turkey are important.

14. The new 20-year tax exemption for foreign income

Law No. 7582 introduced a far-reaching tax benefit in 2026 for certain individuals who become tax residents in Turkey.

Under certain conditions, income earned outside of Turkey can be exempt from Turkish income tax for 20 years. To qualify, the individual must generally not have been resident in Turkey or subject to any corresponding tax liability in Turkey during the three preceding calendar years.

Source: Gelir İdaresi Başkanlığı (GİB) — Law No. 7582 • In-depth (own contribution): 20 years tax-free in Turkey

Up to 20 years of tax exemption 2026 +20 years Law No. 7582 — applies retroactively from 1 January 2026 Prerequisite: no Turkish residency in the three previous years, application for Turkish citizenship (İstisna Belgesi)

Furthermore, an official İstisna Belgesi, or exemption certificate, must be applied for. The regulation applies retroactively from January 1, 2026. However, this does not mean that every German pension, every foreign salary, and every foreign rental income is automatically tax-free. Rather, the following must be checked, among other things:

  • Tax residency
  • Origin and type of income
  • Actual place of performance
  • Site risks
  • Relevant double taxation agreement
  • Existing tax liability in Germany
  • Time of the move
  • Previous Turkish tax registrations

Income from an activity actually carried out from Turkey may, for example, be assessed differently than purely passive foreign income.

The inheritance tax of one percent does not apply to everyone.

The one percent inheritance tax mentioned in the law is not a general new inheritance tax for all emigrants. It primarily applies to inheritances during the preferential period for individuals who meet the requirements for the new tax exemption. Therefore, personal eligibility must be carefully verified beforehand.

15. Your checklist before buying real estate

Before making a binding reservation, at least the following points should be clarified:

1

Is the seller actually the owner?

2

Are there any mortgages, garnishments, or other encumbrances?

3

Do the tapu, the building plan, and the actual condition match?

4

Is an İskan available, or why is it missing?

5

Is the use as a residence permitted?

6

Is the property suitable for the intended purpose?

7

Is the address affected by residency restrictions?

8

What value is specified in the Tapu?

9

How are the purchase price and fees paid?

10

Is a DAB radio required?

11

What expert opinions or valuations are required?

12

Are there any outstanding debts owed to the administration or utility companies?

13

Is short-term rental actually permissible?

14

What tax consequences would a later sale have?

15

Who will accompany the translation and the land registry appointment?

Frequently Asked Questions

Can I, as a German citizen, buy a property in Turkey?+

In principle, yes. However, the legal restrictions on acquisition, the property status, and the required land registry documents must be checked.

Will I automatically receive Ikamet upon purchase?+

No. Property ownership alone does not guarantee a residence permit. Additional requirements, including a value limit, residential use, address, and personal qualifications, must also be met.

Is Kat İrtifaki always dangerous?+

No. However, it must be verified whether the building has been completed, whether an İskan (construction permit) exists, and whether the actual construction matches the permit.

Is an appraisal equivalent to the market price?+

No. An expert opinion or an official valuation can provide an important indication. However, the actual achievable market price may be higher or lower.

Is a property sale tax-free after five years?+

In Turkey, private capital gains are generally exempt from income tax after the statutory five-year holding period. However, commercial activities, German tax liability, or other special circumstances may lead to a different assessment.

Can I rent out my apartment via Airbnb?+

Only if the legal requirements for tourist rentals are met. For apartments in multi-family buildings, obtaining the necessary consent from the other owners is often the biggest obstacle.

Conclusion: Security begins before the signature.

A property in Turkey can be a long-term home, a retirement plan, or an investment. However, security is not guaranteed by a beautiful property or an official-looking document alone. Therefore, the entire process should be viewed as a cohesive whole: selection, inspection, valuation, contract, payment, title deed (Tapu), occupancy, residence, and eventual sale.

1. Ownership only comes into existence through the registration of the Tapu: A purchase agreement, reservation, or payment alone do not make one the owner.
2. Check the İskan and building plan comparison: A tapu alone says nothing about the legal status of the building.
3. Always make payment subject to conditions: Remaining payments will only be made after charges have been cleared and the transfer has been confirmed.
4. Check the Ikamet and purchase separately: Clarify address, value and current blacklists before booking.
5. Plan for a five-year period when selling: The value declared in the Tapu later determines the tax burden.
6. Personal support without sales pressure: Open questions belong before the down payment, not after.
